General terms and conditions (GTC)
Mediation terms governing the use of complimentary credit brokerage services and the website kreditfair-de.com.
Last updated: 13.10.2026
1. Scope & Subject Matter
These Terms and Conditions apply to all loan mediation inquiries and usage of the KreditFair platform. KreditFair provides mediation services between prospective borrowers and licensed credit institutions across Germany and the European Union.
2. Legal Status as Credit Intermediary
KreditFair is an independent loan broker authorized under § 34c(1) sentence 1 no. 2 GewO and is not a banking institution under the German Banking Act (KWG). KreditFair does not originate loans on its own balance sheet and never takes deposits or holds client funds.
3. 100% Free for Borrowers (§ 655c BGB)
Our loan comparison tools, personal advisory, and loan quotation requests are completely free of charge for borrowers. KreditFair never charges upfront fees, processing charges, expense reimbursements, or mandatory supplementary product fees. KreditFair is compensated solely by a standard intermediary commission paid by the funding partner bank upon successful disbursement.
4. Non-Binding Nature of Quotes & Inquiries
Credit inquiries and online calculations on this website are legally non-binding. Displayed interest rates serve orientation purposes (representative APR example pursuant to § 17 PAngV). A legally binding credit contract is concluded exclusively between the borrower and the selected bank, subject to credit checks and signed documentation.
5. Customer Duties of Cooperation
The borrower commits to providing all information necessary for credit evaluation (income, existing debt obligations, financial status) truthfully, accurately, and completely. Any material changes prior to loan execution must be reported promptly.
6. Solvency Checks & Credit Score Protection
To obtain personalized loan terms, the user consents to forwarding their information to partner lenders for score-neutral condition inquiries. Inquiring through KreditFair will not harm your credit rating or SCHUFA score.
7. Statutory Consumer Right of Withdrawal
For the loan agreement signed with the lending institution, the customer has a statutory 14-day right of withdrawal pursuant to §§ 495, 355 of the German Civil Code (BGB). The lending bank provides its statutory withdrawal notice separately prior to execution.
8. Limitation of Liability
KreditFair accepts unlimited liability in cases of intent and gross negligence. For slight negligence, liability is limited to breaches of essential contractual duties (cardinal duties) and foreseeable direct damages. KreditFair does not warrant or guarantee loan approval by partner banks.
9. Dispute Resolution & Governing Law
The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Consumers may use the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) or contact the arbitration boards at BaFin or Deutsche Bundesbank free of charge.
